General terms of sale.
Our services are intended exclusively for professionals. Any order implies full acceptance of these terms.
1. Purpose
These terms govern the sale of 228 OPERATORS services: The 90-Day Plan, L’Acquisition, Le Système, L’Opération and, where applicable, any subsequent service agreed in writing between the parties.
2. Service descriptions
The 90-Day Plan: a written assessment of your operations and a 30, 60 and 90-day action plan, followed by a Google Meet call.
L’Acquisition: a monthly lead generation service. We set the audience strategy and the angles, build your campaigns, measure and optimize them, and every lead is followed through to the appointment.
Le Système: a monthly automation service. We connect your tools (CRM, forms, payments), take over your follow-ups and recurring tasks, and bring your numbers together in one place.
L’Opération: a monthly service with a scope defined together with you. It may include monitoring response times, maintaining the CRM and data, monitoring campaigns and a monthly summary. Actions performed in your name and applicable service levels are specified in the engagement.
3. Price
The price is the one agreed between the parties at the time of order. Setup fees are fixed. The monthly rate of a subscription may be revised with thirty (30) days’ written notice; the revision applies to the following billing cycle. Applicable taxes (GST, QST) are added where relevant and appear on the invoice.
4. Payment
Payment is made via Stripe, a secure payment platform. No banking data is stored by our systems. Setup fees are payable at the time of order. The monthly subscription is charged automatically each cycle. If a charge fails and remains unpaid ten (10) days after our written notice, the service may be suspended until payment is settled.
5. Delivery and go-live
The 90-Day Plan is delivered within three (3) business days after we receive your payment and completed questionnaire answers. A Google Meet call is scheduled shortly after delivery. For L’Acquisition, Le Système and L’Opération, the service goes live after the setup call; when messages are sent under your name, go-live is conditional on your approval of those messages.
6. Best-efforts obligation
Our services constitute a best-efforts obligation: we apply our expertise with rigour, without guaranteeing a specific commercial outcome. Response times or service levels agreed in the engagement may depend on third-party networks and platforms over which we have no control.
7. Revision and refund
The sale is intended for professionals. No statutory withdrawal right applies. Once the 90-Day Plan has been produced and delivered, no refund is possible. If a section of the plan does not reflect your context, we rework it until it is right. In case of cancellation before work begins, a full refund may be granted on written request. Setup fees for a monthly service are non-refundable once setup has been completed.
8. Subscription, renewal and cancellation
Unless a different initial term is agreed in the engagement, the subscription renews automatically each month. You may cancel by email at [email protected]; cancellation takes effect according to the engagement or, if unspecified, at the end of the current billing cycle, with no refund for the month already in progress. We may terminate with thirty (30) days’ written notice. Data handover terms are specified in the engagement.
9. The 90-Day Plan credit
The 90-Day Plan is the entry point to our services. If, after delivery, you enter into a paid initial engagement of at least three (3) months for L’Acquisition, Le Système or L’Opération, the price paid for The 90-Day Plan, namely CAD $799 before taxes, is applied as a credit to the third-month invoice. The credit is conditional on payment of the first two months and the engagement remaining active through the third month. It is not redeemable for cash or otherwise refundable.
10. Confidentiality and data processed on your behalf
Information shared during our services is handled in strict confidence. We disclose your data only to the providers named in our privacy policy, who act on our instructions solely to deliver the service. As part of L’Acquisition, Le Système and L’Opération, your clients’ and prospects’ contact details pass through our systems; we process them solely to deliver the service, in accordance with that same policy. You warrant that your communications with these recipients comply with applicable laws, including Canada’s Anti-Spam Legislation.
11. Ownership
Delivered documents become your property. Our internal methods, models, templates and tools remain our intellectual property. Ownership and usage rights for configurations completed in your accounts are specified in the engagement.
12. Liability
Our liability is limited to the amounts paid for the relevant service over the last twelve (12) months. We cannot be held liable for indirect damages, loss of profits, consequences of decisions made on the basis of a deliverable, or unavailability attributable to third-party networks or platforms.
13. Applicable law and jurisdiction
These terms are governed by the laws of Quebec (Canada). Any dispute shall, failing amicable settlement, fall under the jurisdiction of the competent courts of the Montreal district.
